Tuesday, June 16, 1981 Part II 3 D. A. Clears 2 Policemen in Boy's Death Compton Officers Fatally Wounded Youth Fleeing Shooting Scene All three bullets struck Valesquez, killing him instantly. Officers found a sawed-off 12-gauge shotgun on the left rear floorboard of the car Valesquez was riding in, according to the report. Thomas Lute, who had been in the car with Valesquez, later pleaded guilty to two counts of assault with a deadly weapon, said Deputy Dist.

Atty. Dennis E. Whe-lan, who wrote the report. The woman in the car was not arrested. Lamont Hardwell of Compton, who was wounded in the chest and right thigh in the earlier street shooting incident, was later treated and released from Domin-guez Valley Hospital.

Whelan said Jackson and Garland "committed no criminal offense" and that the "actions of both officers were proper and justified under the law concerning justifiable homicide and self-defense." mm By BILL HAZLETT, Times Staff Writer No criminal charges will be filed against two Compton police officers who shot and killed a 16-year-old boy involved in an earlier shooting incident, the district attorney's office said Monday. Luis Valesquez of Compton was killed Jan. 8 by Officers Brett Garland and Jasper Jackson after a pursuit from the scene of a shooting in which a teen-age boy was wounded. Garland and Jackson were driving near Kelly Park in Compton when they heard two gunshots and saw an armed youth running toward a waiting car, according to a report by the district attorney's special investigations division. The officers pursued the speeding car for several blocks before it ran out of gasoline and coasted to a stop.

During the chase, one of the passengers threw a rifle out of the car, the report said. Failed to Obey Taking cover behind their patrol car, Garland and Jackson ordered the two males and one female inside the car to put up their hands, but Valesquez opened the left rear door, climbed out and crouched behind the door, according to the report. The officers ordered Valesquez to raise his hands, but when he failed to obey and made a sudden move with his hands toward his waistband, Garland fired twice with his service pistol and Jackson fired once with his .357 magnum service revolver.
